How Does Section 8 Work?

The Housing Choice Voucher Program provides housing assistance, in the form of Section 8 vouchers, to low-income families. The Section 8 vouchers are used to help the family pay for housing. Local public housing agencies (PHA) administer vouchers based on household income and family size and recipients are free to choose any housing that meets program requirements.

In general, Section 8 housing program follows the below structure:

  • The individual/household applies for the Section 8 Housing Choice Voucher Program.
  • The applicant is likely placed on a waiting list that may take more than 1-2 years.
  • During this time, the applicant can also choose to accept project-based vouchers.
  • Once the applicant is approved for a tenant-based voucher, they can begin to look for an apartment or home.
  • The applicant can only use the voucher at properties that accept Section 8 vouchers and meet Section 8 requirements, including a physical inspection.
  • Once the property is approved, PHAs will pay a portion of rent on their behalf.
  • If the applicant is approved for project-based housing vouchers, a PHA can refer the applicant to a project-based assistance property owner with a vacant unit.
  • If the applicant is screened and accepted by the property owner, the PHA will pay the portion of rent on their behalf.

Steps to Get Section 8 Housing or Section 8 Apartments

  1. Find your local Public Housing Agency (PHA). This is the first place to start. The Housing Choice Voucher program, although overseen by the U.S. Department of Housing and Urban Development (HUD), is administered by local PHAs.   2. Determine if you are eligible. The PHA will help determine if you are eligible for Section 8 assistance. This is based on both the family size and the total annual gross income — in general, the income may not exceed 50 percent of the area’s median income. Section 8 is also limited to US citizens and certain categories of non-citizens with eligible immigration status.
  3. Obtain an application for the Section 8 Housing Choice Voucher program. Applications for the Housing Choice Voucher program are entirely free, and depending on the PHA, will available online, by mail or at the local housing authority’s office.
  4. Fill out and submit the Section 8 Housing Choice Voucher program application. Typically, the application will ask for the following from all household members: name, date of birth, Social Security Number and gross income of those applicable. Other requirements might include mailing addresses, email addresses, housing history, criminal history, phone numbers and more. Follow all instructions when submitting the application to ensure it will be processed correctly and efficiently.
  5. Find out Waiting List status. After the housing office processes the application, individuals and families will either be rejected or placed on a waiting list. Even if applicants are eligible, applications can be rejected because of high demand or because they weren’t chosen in a random lottery; the PHA must provide reasoning, however, and applicants can request an informal review.
  6. Confirm waiting list placement: Unfortunately, many waiting lists can be years long, given general lack of funding in relation to the increased demand for affordable housing. It can take up to a few months to process the application, but once it is processed, housing authorities will either confirm waiting list placement by mail or by logging into an online portal.

Housing choice vouchers are administered locally by public housing agencies (PHAs). The PHAs receive federal funds from the U.S. Department of Housing and Urban Development (HUD) to administer the voucher program. A family that is issued a housing voucher is responsible for finding a suitable housing unit of the family’s choice where the owner agrees to rent under the program. This unit may include the family’s present residence. Rental units must meet minimum standards of health and safety, as determined by the PHA.

A housing subsidy is paid to the landlord directly by the PHA on behalf of the participating family. The family then pays the difference between the actual rent charged by the landlord and the amount subsidized by the program. Under certain circumstances, if authorized by the PHA, a family may use its voucher to purchase a modest home.

There are five eligibility requirements for admission to Section 8 or public housing: have an annual income at or below the income limits; meet one of PHA’s definitions of family; have at least one family member who is either a U.S. citizen or an eligible immigrant; provide Social Security numbers for every family member age 6 or older or certify that they do not have Social Security number; and sign consent authorization documents. In addition to the eligibility criteria, families must also meet KCDC screening criteria in order to be admitted and allowed to complete a Section 8 housing application.

Texas Section 8 Housing Choice Voucher program offers rental assistance to low-income individuals and families living in Texas. Financially struggling families can’t afford to pay rent for decent housing. Section 8 assistance is for such families so that they can afford safe and sanitary residence in the public housing market.

The program is funded by U.S Department of Housing and Urban Development (HUD) and administered by local Public Housing Agencies (PHAs). The PHA receives applications for the programs and maintains a waiting list. A PHA will close the waiting list when it runs out of funds or has already received enough applications considering the funds it has received. Applicants will need to confirm that the waiting list is open before filing the application. Eligible individuals and families can apply with more than one PHA to be sure that they have a better chance of getting Section 8 assistance because of long waiting lists with most PHAs.

Texas Section 8 participants are free to choose a house that meets their requirements. Once a participant has picked a housing, a PHA representative will inspect it for quality and safety standards. If the housing meets HUD’s standards, participant will be allowed to sign a contract of lease with the landlord. The PHA will also sign a contract with the landlord to provide the rental subsidy directly to the landlord. When a participant signs a contract with the landlord, he/she will be responsible to act as a responsible tenant. The landlord will be able to eject the Section 8 tenant on any grounds that can result in ejection of a regular tenant.

Who can Qualify for Section 8?

Texas Section 8 Housing Choice Voucher program requires applicants to meet the following program requirements to receive rental assistance.

Annual Gross Income: Texas Section 8 Housing Choice Voucher program is for low income residents and that’s the reason program uses annual gross income to determine applicants’ eligibility for the program. The program provides rental assistance only to those who have income below 50% of the median income level. The program has a policy to provide 75% vouchers to applicants with income below 30% of the median income level.

Citizenship: Applicants should be U.S citizens or a qualified aliens with necessary legal documents. A household with at least one U.S citizen or a qualified alien will be able to qualify for the program.

Residence: Texas Section 8 assistance is only available to residents of Texas. If you’re living outside the Texas, you’ll need to apply with PHAs that operate in your state.

Family status: Applicants will need to fall within the definition of family. It may include disabled, elderly, and displaced individuals.

Background check: PHA will run a background check on eligible participants to ensure that they will prove to be good tenants. The program will not accept anyone who has been evicted from public housing on a previous occasion because of drug-related criminal activity.

The PHA will also rely on direct verification from your employer, etc. You will be asked to sign a form to authorize release of pertinent information to the PHA.

The Section 8 application for Los Angeles is only for the housing choice voucher program. A very low-income family is selected by the PHA to participate is encouraged to consider several housing choices to secure the best housing for the family needs. A housing voucher holder is advised of the unit size for which it is eligible based on family size and composition. The housing unit selected by the family must meet an acceptable level of health and safety before the PHA can approve the unit. When the voucher holder finds a Section 8 unit that it wishes to occupy and reaches an agreement with the landlord over the lease terms, the PHA must inspect the dwelling and determine that the rent requested is reasonable.

When someone wants to apply for Section 8 in California, the PHA determines a payment standard that is the amount generally needed to rent a moderately-priced dwelling unit in the local housing market and that is used to calculate the amount of housing assistance a family will receive. However the payment standard does not limit and does not affect the amount of rent a landlord may charge or the family may pay. A family which receives a housing voucher after completing a Section 8 application can select a unit with a rent that is below or above the payment standard. The housing voucher family must pay 30% of its monthly adjusted gross income for rent and utilities, and if the unit rent is greater than the payment standard the family is required to pay the additional amount. By law, whenever a family moves to a new unit where the rent exceeds the payment standard, the family may not pay more than 40 percent of its adjusted monthly income for rent. Public housing is actually a different program that is administered by the Housing Auhtority.

The PHA will also consider both of your family assets and composition.

Steps

First, you need to properly prepare the documents. You should ask for pay stubs from your employer and documents that indicate your current rent or mortgage information.

You also need to know which kind of assistance that you need. People wanting to have their own home should apply for property voucher, which can help them pay the mortgage. Meanwhile, people who need a renting assistance should apply for a tenant voucher.

Now that you have everything’s ready, you can use the PHA office list in our reference section and contact the one that is near you. It would be best if you can call them beforehand and ask if there’s an online application available.

Now here’s the hard part: waiting. As we have said earlier, the program is insanely popular. Many of the applicants have to wait for years before they get approval for the program. Just as you may have expected, the money from the HUD is not limitless.

That said, there are some PHAs that prioritize some families, depending on the condition. This is (again) determined by your application. Typically homeless, families that pay more than 50% of income for rent, families living in substandard houses etc are eligible for this prioritization.

Most importantly, you should NEVER commit fraud when you apply for this assistance. The HUD and PHA are pretty strict about this, and people committing fraud will lose all benefits and may have to face legal charges and prison.

SPECIFIC INFORMATION ON HOW TO APPLY FOR SECTION 8 VOUCHER

Step 1: Obtain the application.

As discussed above, applications are generally available online, by mail, or at the San Mateo County housing office. It is possible that applications are only being accepted online now, so check the website.

If, however, you are a disabled person, and you cannot complete the application online or on paper, you can have another person, a relative, or a social worker complete the application on your behalf.

Hopefully, if you do not have online access to the Internet, a friend or relative will let you use their computer or go to the local library. It is also possible that the online application may require you to create a free account which requires you to have a valid email address. If you do not have an email address, you can request a free email address through Google.

Step 2: Complete the application.

The first application is usually a preliminary application where you will be required to provide your first and last name, date of birth, Social Security number or alien ID, and everyone’s gross income that lives with you, including your children. You may also be required to provide your address, phone number, gender, disability status, race, housing, and criminal history.

Step 3: Apply.

The application must be submitted as per the San Mateo County Housing Authority instructions, or it will be disqualified.

What are the Basic Requirements of Section 8?

Section 8 housing voucher applicants must be at least 18 years old and a United States citizen or a noncitizen who has eligible immigration status.

Single persons are also eligible as well as households or “families” without children. You are not required to have children to qualify as a household or family, as discussed above. You can apply in any county to live in any other location throughout the US, although check local housing authority rules as applications may be limited to “residents.”

Income Eligibility

Your household must make less than 50% of the Area Median Income (AMI) for the area where the voucher will be used (this is known as the income limit). That is determined by looking at your gross income and then subtract taxes and other expenses.

Restrictions and Preferences

Preferences

Many waiting lists have preferences. In other words, if you are a person with disabilities or over the age of 55, you may receive a priority and will receive housing assistance before others on the waiting list. You can still apply even if you do not qualify for preference.

The waiting list may be open only to specific individuals, such as the homeless or disabled. You will be notified if this is the situation.

You may be disqualified if:

You may be disqualified from receiving a housing voucher if you have been evicted from HUD housing in the past, had your voucher or assistance terminated, or if you owe money to a housing authority.

If you have a criminal record, you will not be automatically disqualified, but it may be more difficult to obtain housing. If you were never convicted of the crime, you would have a better chance than a person who has a criminal conviction on the record. If you are a convicted felon, especially if the crime of violence or drug-related, it will be more difficult. Similarly, people with a history of drug use, alcohol issues, and other criminal activity may have difficulty qualifying for assistance.

Make sure that you are truthful in the information you provide on the application because providing false information disqualifies your application.
